PLEASE READ THIS CAREFULLY. THE FOLLOWING TERMS AND CONDITIONS CONSTITUTE A BINDING AGREEMENT BETWEEN YOU AND photo.com.bd. By using the photo.com.bd website (“Site”) and/or downloading any content, you agree to be bound by and comply with this Site Usage Agreement (“Agreement”). If you do not wish to be bound by this Agreement, do not use this Site.

We respect our users' intellectual property, and claim no copyright to anything posted on the site by our users. However, as a stipulation of using photo.com.bd, we retain the right to keep and display anything posted by users on photo.com.bd as part of the site indefinitely.

Liability. The Publisher accepts no liability in respect of the content of any third party material appearing on the Website or in respect of the content of any other website to which the Website may be linked from time to time. The Publisher makes no warranty in respect of the contents of this Website and accepts no liability for any loss or damage whatsoever and however arising whether directly or indirectly as a result of access to and use of this Website including without limitation acting or failing to act in reliance on any information contained herein.

Indemnity. You understand that you are personally responsible for your behavior while on the Website, and agree to indemnify and hold the Publisher, all other companies within the photo.com.bd, their parents, subsidiaries, affiliates, and their officers, directors, employees and agents harmless from and against any loss, damage, liability, cost or expense of any kind (including legal fees and costs) that they may incur in connection with a third party claim or otherwise, in relation to your use of the Website, access to the Website, your violation of either these Terms or the rights of any third party, disclosure of membership passwords and any other matter in connection with your participation in the services on the Website.

• the service is presented "as is", the developer does not give any guarantees of the functioning and work of the site;
• all images (photographs) are the property of their authors; We respect our users' intellectual property, and claim no copyright to anything posted on the site by our users.
• all photos must be your own (not from other web-pages, web-pages, scanned from magazines etc);
• images which are completely created with a computer are prohibited;
• images created specially to advertise some web-sites are prohibited;
• photo.com.bd reserves the right to delete/modify any photo/album/comment without showing any reason at any time;
• images must based on the author's own photographs (taken with user's own hand) taken on film or digital camera or mobile camera;
• any reproductions of images that not photos (paintings, canvases, pictures, drawings, illustration, screenshots, computer graphics etc) are prohibited;
• uploading any porno photos is prohibited, erotic photographs of children are prohibited;
• a user must not have 2 or more the same images in his gallery;
• photographs inobservant the rules removing without any notification;
• photographs that can be considered as belonging to "the family album" (those that appeal primarily to your family and friends) are not welcome;
• each registered user is provided 35MB free space to upload photos. More space can be provided upon request;
• if your comment is insulting - the account of the user can be blocked, and on repeating of unethical - account can be removed without any notification;
• if the comment of the critic does not corresponds with the rating (plus) of the critic, the rating (plus) can be removed;
• user must not create and/or use more than one account excepting accounts, allowed by administration;
• As our userbase has grown we've got more and more inactive or unused accounts. Accounts will be deleted, if the account has no uploaded/displayed images and it was registered more than 30 days ago;
• producing a lot of identical comments with software for auto filling forms (or other software) or with copy & paste method are prohibited, these comments are interpreted as a spam and may be removed without any notification, and for the user may takes appropriate measures up to removing the account;
• photographs might be removed without any notification, in case of questionable originality, copyright, owner etc.
• photo.com.bd reserves the right to modify or terminate the service, without notice at any time, without showing any reason;
• photo.com.bd reserves the right to refuse service to anyone without notice at any time, without showing any reason;
• photo.com.bd reserves the right to remove any photo/comment/user without notice at any time, without showing any reason;
• the statistics system, the rating system, awards system and these rules can be changed at any time without any personal notification;

photo.com.bd does not claim ownership of the materials you provide to photo.com.bd (including feedback and suggestions) or post, upload, input or submit to photo.com.bd website (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your submission you are granting photo.com.bd, its affiliated companies and necessary sublicensees permission to use your submission in connection with the operation including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your submission; and to publish your name in connection with your submission.

No compensation will be paid with respect to the use of your submission, as provided herein. photo.com.bd is under no obligation to post or use any submission you may provide and may remove any submission at any time in photo.com.bd's sole discretion. By posting, uploading, inputting, providing or submitting your submission you warrant and represent that you own or otherwise control all of the rights to your submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the submissions.

These Terms of Use contain the entire understanding of the parties hereto relating to any use of this Site and supersedes any prior written or oral agreement or understandings between the parties with respect to this Site, and cannot be changed or terminated orally. The invalidity or unenforceability of any provision of these Terms of Use will not affect the validity or enforceability of any other provision of these Terms of Use. photo.com.bd reserves the right to modify or terminate these Terms of Use without notice, if, in photo.com.bd sole discretion, you fail to comply with any term of these Terms of Use. Upon termination, you must destroy all materials obtained from this site, copies and related documentation thereof. In addition, photo.com.bd reserves the right to terminate this site without notice.
